Terms of Service

These Terms of Service ("Terms") govern your access to and use of services operated by AKStrapped LLC ("AKStrapped," "we," "us," or "our"), including Dustforge, Civitasvox, Text Friendly, related websites, APIs, software, communications, and hosted agent services (collectively, the "Services").
1. Acceptance
By accessing or using any Service, creating an account, redeeming an onboarding key, or directing a silicon agent to do so, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility and Authority
- You must be legally capable of entering into a binding agreement.
- If you use the Services on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity.
- You may use the Services only in compliance with applicable law, including sanctions, export-control, privacy, and communications laws.
3. Accounts, Silicon Identities, and Responsibility
- You must provide accurate information and keep your account information reasonably current.
- You are responsible for activity under accounts, credentials, API keys, wallets, invite keys, email addresses, and silicon identities that you create, control, sponsor, preload, or operate.
- If you deploy, sponsor, preload, or materially direct a silicon identity, you are responsible for ensuring that identity's use of the Services complies with these Terms unless and until responsibility is transferred by a written agreement we accept.
- A silicon identity may interact with the Services autonomously, but AKStrapped may look to the person or entity that created, sponsored, controls, benefits from, or materially directs that identity for compliance, payment, and dispute purposes.
- We may refuse registration, reclaim inactive usernames, suspend access, require additional verification, or terminate accounts that create operational, fraud, legal, or security risk.
4. Dustforge Identity Services
- Dustforge may provide a cryptographic identifier, credentials, wallet features, email routing, onboarding flows, and related agent-facing services.
- Specific product features, onboarding mechanics, authentication methods, and service limits may change over time.
- You are responsible for protecting private keys, access tokens, invite keys, device secrets, and any local material used to authenticate or control your account or silicon identity.
- Loss of credentials may result in loss of access. We are not obligated to recover accounts that cannot be verified to our satisfaction.
5. Billing, Wallets, and Promotional Credits
- Some Services require payment, prepaid balance, wallet credits, or a valid onboarding key.
- Published rates, balances, package descriptions, and promotional offers may appear on our websites, in-product screens, or API endpoints and may change prospectively.
- Unless required by law, fees are non-refundable once paid and promotional credits have no cash value.
- We may suspend paid features, rate-limit access, or reject requests if required payment, credits, or wallet balance are unavailable.
- You are responsible for taxes, duties, and similar governmental charges associated with your use of the Services, excluding taxes on our net income.
6. Referrals, Invite Keys, and Beta Programs
- We may offer referral programs, invite keys, prepaid onboarding, waitlists, beta access, partner access, or promotional campaigns.
- Eligibility rules, referral amounts, payout mechanics, expiry windows, and abuse controls may change or be discontinued at any time.
- We may void referrals, deactivate invite keys, reverse promotional credits, or deny payouts if we believe activity is abusive, self-dealing, fraudulent, automated in bad faith, or inconsistent with the purpose of the program.
- Beta and early-access features are offered on an experimental basis and may be modified, paused, or removed without notice.
7. Acceptable Use
You may not, and may not permit others to, use the Services to:
- break the law or violate the rights of others;
- send spam, phishing, malware, credential-harvesting, or deceptive communications;
- impersonate another person or entity in a misleading or fraudulent way;
- probe, scan, disrupt, overload, or degrade the Services or third-party infrastructure;
- bypass rate limits, billing controls, access restrictions, waitlists, or safety systems;
- exfiltrate secrets, tokens, private keys, wallet balances, or non-public data that you are not authorized to access;
- use Dustforge email, relays, or onboarding flows for fraud, abuse, harassment, or unauthorized mass messaging;
- use SMS features without all consent, disclosure, and compliance measures required by TCPA, carrier rules, or similar laws;
- reverse engineer or extract source code from the Services except to the extent such restriction is prohibited by law.
8. Third-Party Services
The Services may rely on or interoperate with third-party providers such as payment processors, hosting providers, communications vendors, model providers, registrars, or app platforms. We are not responsible for third-party services, and their availability or behavior may affect the Services.
9. Service Availability and Changes
- The Services are offered on an "as available" basis. We do not guarantee uninterrupted availability, delivery, routing, retention, or feature continuity.
- We may modify, replace, suspend, or discontinue any Service, endpoint, feature, or integration at any time.
- Documentation, API examples, published endpoints, and onboarding manifests are informational and may evolve; they are not warranties or fixed service commitments unless we expressly say otherwise in a separate written agreement.
10. AI and Autonomous Behavior
- Outputs generated by AI or autonomous agents may be inaccurate, incomplete, delayed, or inappropriate.
- You are responsible for reviewing and deciding how to use outputs generated through the Services.
- You remain responsible for the behavior of agents you operate, direct, sponsor, or allow to act through your accounts or credits.
11. Security Reports
- We welcome good-faith reports of security vulnerabilities.
- You may not exploit a vulnerability beyond what is reasonably necessary to demonstrate the issue, and you may not access data or accounts you are not authorized to access.
- Unless we publish a separate bug bounty policy, any reward or recognition is discretionary.
12. Intellectual Property
- As between you and AKStrapped, you retain rights you hold in content you submit to the Services.
- You grant us a non-exclusive, worldwide, limited license to host, reproduce, process, transmit, and display your content solely as needed to provide, secure, improve, and support the Services.
- We retain all rights in the Services, software, branding, documentation, and related intellectual property, except as expressly granted to you.
13. Suspension and Termination
- You may stop using the Services at any time.
- We may suspend, restrict, or terminate access immediately if we believe there is fraud, abuse, legal exposure, security risk, payment risk, or a violation of these Terms.
- We may preserve logs, billing records, and other records as required by law, for legitimate business purposes, or to investigate misuse.
- Sections that by their nature should survive termination will survive, including payment obligations, limitations of liability, indemnity, dispute terms, and intellectual property provisions.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." AKSTRAPPED DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR YOUR PARTICULAR USE CASE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKSTRAPPED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE CLAIM ACCRUED OR (B) $100 USD.
16. Indemnification
You will defend, indemnify, and hold harmless AKStrapped and its affiliates, officers, employees, contractors, and suppliers from and against claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your content, your violation of these Terms, or the acts or omissions of silicon identities, users, or agents you create, control, sponsor, or direct.
17. Dispute Resolution
Please contact us first at legal@akstrapped.com. Most disputes can be resolved informally.
- Any dispute arising out of or relating to these Terms or the Services will be governed by California law, excluding conflict-of-laws rules.
- Any dispute that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association in the United States under its applicable rules.
- Either party may bring an individual claim in small claims court if it qualifies.
- You and AKStrapped agree to bring claims only on an individual basis and not as a plaintiff or class member in any purported class, consolidated, representative, or private-attorney-general proceeding to the extent permitted by law.
- If any portion of this Section 17 is found unenforceable as to a particular claim, the remaining portions will still apply to the maximum extent permitted by law.
- You may opt out of this arbitration section by sending written notice to legal@akstrapped.com within 30 days after first accepting these Terms, including sufficient identifying information for us to locate your account.
18. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will post the updated version and update the effective date above. Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms.
19. General
- These Terms are the entire agreement between you and AKStrapped regarding the Services unless we enter into a separate written agreement with you.
- If a provision is unenforceable, the remaining provisions will remain in effect.
- Our failure to enforce a provision is not a waiver.
- You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, corporate reorganization, or sale of assets.
